New York Sexual Abuse Bill to Include Public Institutions

The New York Times reported today on important changes to a highly debated proposed bill that has the goal to temporarily suspend the statute of limitations on lawsuits claiming childhood sexual abuse. 

Assemblywoman Margaret M. Markey has announced a change to her proposal (known as the Child Victims Act) to include individuals who have been abused in public instutions as well as private institutions.  Previously, the bill only provided for those lawsuits against private entities.

The Child Victims Act would extend the current statute of limitations in sexual abuse cases.  Currently, a survivor of sexual abuse has 90 days after his or her 18th birthday to file a lawsuit against his or her abuser if the suit is against a public institution and 5 years after his or her 18th birthday if the suit is against a private institution, such as a church or non-secular school. 

If the Child Victims Act of New York passes, the statute of limitations would be extended to 10 years after the sexual abuse survivor turns 18.  Additionally, the proposed bill would entirely suspend the statute of limitations for a one year window for individuals who are 53 years old and younger at the time of the enactment of this statute (if it is enacted).
